Responsible use of GPS devices
Mongoose GPS units are designed to provide the user with a convenient and simple to use GPS product for private or business customers.
GPS tracking devices need to be used responsibly, with disclosure and consent of drivers and not breach any privacy rights. Mongoose GPS trackers are not for covert use. You must disclose to any driver/user that you are using a GPS tracking system.
All customers need to ensure that they install and use GPS tracking devices in accordance with all applicable laws, regulations, standards and industry code of conduct.
If you are a business or private user of a GPS system you have the responsibility to check your relevant State or Federal legislation or seek suitable legal advice.
GPS Tracking Terms of Service
Mongoose Australia Pty Ltd offer vehicle or asset tracking devices that has access to a smartphone application or website for private and businesses users to locate and manage their vehicles/assets. This will be referred to in these terms of service as “Tracking Service”
- These terms of service are set out to ensure that the YOU (the user) of the tracking service understand your responsibilities for usage of this service, and to set out the limits of responsibility of the service tracking provider (Mongoose Australia Pty Ltd)
- This agreement is made between YOU (the user) and Mongoose Australia Pty Ltd
- By using Mongoose Australia Pty Ltd tracking service YOU agree to be bound by the terms of service.
- Your tracking service may be suspended or cancelled if YOU are found to have broken these terms of service.
- You must ensure that all information provided to Mongoose Australia Pty Ltd is accurate and complete and you are authorised to provide such information for use of tracking service including when creating any tracking service account.
- YOU are responsible for keeping your tracking service details confidential and for all activity on your account including any authorised users activity.
- You will ensure that You, or employees or agents, will not use this tracking service, or any part of it, for any unlawful or illegal acts and will ensure it is used in accordance with any applicable Local, State, Territorial or Australian laws or industry standards. Mongoose Australia Pty Ltd does not provide legal advice, You have the responsibility to check your relevant legislation or seek suitable legal advice.
- You must only install and use tracking system devices in vehicles or assets that YOU own.
- You have the responsibility to disclose use of GPS tracking system to other Drivers/operators and obtain consent were necessary that Vehicle/Asset is being tracked. This tracking service is NOT for Covert use.
- It is your responsibility on a regular basis to access your tracking service and ensure it is active and functioning correctly, You must notify Mongoose of any unauthorised use of your tracking service including unauthorised changes of your username and passwords or tracker details, or unauthorised possession or access to your tracking service.
- Mongoose does not warrant that the tracking service will operate on a continuous error free or interruption free basis, but will make all reasonable efforts to remedy any errors in the tracking service or the ongoing availability of the tracking service.
- Mongoose will make all reasonable efforts to ensure the availability of the tracking service and will look to restore the tracking service as soon as reasonably possible in the event of interruptions or make efforts to provide a substitute service. Mongoose does not warrant that the tracking service will be private or secure, or that it will operate without errors or interruptions.
- Mongoose Australia Pty Ltd will provide technical support service during business hours via email or telephone.
You agree that Mongoose Australia Pty Ltd shall not be liable to YOU or any third party for the following:
- Any direct, indirect or consequential losses or damage resulting from the use of this tracking service.
- Any direct, indirect or consequential losses or damage resulting from the unavailability, or errors, or faults in operation of this tracking service.
- Any direct, indirect or consequential losses or damage resulting from your account being suspended or cancelled due to breach of this agreement.
PRODUCT WARRANTY
Mongoose warrants for the period of 1 YEAR (12 months) that it will make good without charge, at Mongoose’s discretion, by way of repair or replacement with the same or with a reasonable equivalent.
It is the product owner’s responsibility to return the GPS tracker for service, repair or replacement at their own cost.
Any claim made to Mongoose under this warranty must comply with the following;
(a) any defect has been notified to the supplying Mongoose dealer as soon as the defect was noticed.
(b) a copy of your retail ‘proof of purchase’ stating where and when it was purchased and (if applicable) who carried out the installation.
(c) the product was manufactured within 12 months prior to the commencement of this warranty period.
(d) the product was purchased from Mongoose or one of its authorised dealers/resellers.
(e) the product has not been disassembled or the manufacturers security seals have not been broken or tampered with.
(f) if installation of the product was required, that it has been installed by a suitably qualified industry recognised person.
(g) that the original installer, or other Mongoose dealer nominated by the original installer, has determined that the reported defect is a genuine product defect and not caused by;
- incorrect operation, incorrect installation or any other consequential damage caused by other equipment not part of this product.
- operation of the product after it is known to be defective
- tampered with, alteration or modification by any person
- the fitment and/or connection of additional parts or accessories not supplied by or approved of by Mongoose
- water damage, misuse, accident, deliberate act or abuse, misdirected electrical current, insufficient or excess voltage, ingress of any fluid or fire
- excessive heat from either the vehicle or the sun
Items not covered by this warranty;
(1) labour costs for removal & refitting of parts
(2) mobile ‘onsite’ service
(3) normal wear and tear
(4) any consequential loss incurred by the failure of this product or SIM card failure
(5) product purchased from internet trading sites which is not supplied by an authorised dealer
(6) Mobile SIM cards
(7) The download and use of the mobile APP and website
(8) Loss of access to App and Website
Warranty when not fitted by auto electrician or suitably qualified persons
This warranty may be void or limited to 6 months ‘manufacturing defects only’ depending on the reasons for repair.
Installation warranty
Warranty on the installation is borne by the installer.
